EEOC, DOJ warn against unlawful DEI discrimination
Two documents warning against unlawful discrimination related to diversity, equity and inclusion in the workplace were released by the Equal Employment Opportunity Commission and the Department of Justice. A one-page document advises individuals on what they can do if they “experience discrimination related to DEI at work.” A Q&A discusses what individuals should know about DEI-related discrimination at work. The documents are based on Title VII of the Civil Rights Act of 1964, existing EEOC policy and Supreme Court precedent. Noting DEI is not defined in Title VII, the agencies contend the “widespread adoption of DEI ... does not change longstanding legal prohibitions against the use of race, sex and other protected characteristics in employment.” (AHA News article, 3/20/25)
