Nursing homes sue to stop implementation of staffing ratios

The American Health Care Association filed a lawsuit earlier this month urging a federal court to overturn the Biden Administration’s mandatory minimum staffing requirements on nursing homes. The suit, filed in the Northern District of Texas, argues the Centers for Medicare & Medicaid Services exceeded its authority. The lawsuit contends the requirements will cause facilities to close or downsize, resulting in tens of thousands of residents needing to find alternate places to live, as well as increasing wait times and care costs.
