Nursing home staffing rule implementation in doubt

Nursing home lobbyists anticipate Republicans will repeal President Biden’s nursing home minimum staffing rule before its implementation. AONL opposes the rule, noting it does not appropriately address workforce challenges. Both Republicans and Democrats have opposed the rule. Once Republicans control Congress in January 2025, they could pass legislation to allow Congress to overturn federal regulations enacted during the final year of the current administration. They also could use the budget and appropriations process to stop the rule’s implementation. In addition, the Trump administration could issue a rule to modify the current one or eliminate it. Several ongoing court cases over the rule offer a path to overturn it. (The Hill article, 12/11/24)
